By entering the property, I acknowledge that this is a working agricultural operation operated by Fresh Earth Bounty LLC (doing business as JenSun Farms). Farms inherently feature natural hazards, including but not limited to: uneven ground, mud, rocks, holes, changing weather conditions, stinging insects, bees, and thorns. I agree to wear appropriate footwear and clothing for an outdoor farm environment.
I acknowledge the mandatory warning under Georgia law:
WARNING: Under Georgia law, there is no liability for an injury or death of a participant in a registered agritourism activity conducted at this agritourism location if such injury or death results from the inherent risks of such agritourism activity. Inherent risks of agritourism activities include, among others, risks of injury inherent to land, equipment, and animals, as well as the potential for you to act in a negligent manner that may contribute to your injury or death. You are assuming the risk of participating in this agritourism activity. (O.C.G.A. § 12-3-101)
I knowingly and voluntarily assume all risks, both known and unknown, associated with my participation in U-Pick activities and entry onto the property, even if arising from the ordinary negligence of the farm owners, operators, employees, or agents.
I, on behalf of myself, my heirs, personal representatives, and assigns, hereby release, waive, and forever discharge Fresh Earth Bounty LLC, dba JenSun Farms, its owners, officers, members, employees, and agents from any and all liability, claims, or demands for personal injury, sickness, or death, as well as property damage and expenses, of any nature, occurring during my visit to the property.
I explicitly state that I have the legal authority to agree to this waiver on behalf of myself, any minor children in my care or party, and all adult guests for whom I am purchasing tickets. I accept full responsibility for supervising any minors accompanying me for the duration of the visit.
